  Q. Correct use of security photos.

Story:
We take a photo of everyone who works in the building to use on their security identity card. These are kept on the server (secured) in case a card is lost.

The company is looking to create a much better intranet site which includes a workers database with photo and contact info.

Question:
Are we (the company) allowed to reuse the photo on a net site without permisison from the person in it. Or do we need a release form to use the photo for anything other than the original reason.

As the IT person putting this all on the company network I need to know what I am doing is ok before I waste too much time on it.

Any advice would be great.

I would think this would be a question for your corporate law department. However, since you are asking lay persons for their advice, I'll give my impression:

The "requirement" of obtaining a photo release from models or in candid street photos, etc. pertains to photographs you intend to publicly display, sell, etc. From what you say, your use is limited to in-house servers, totally inside the corporation. And knowing how employees typically no longer have any rights in the workplace, you probably do not need their permission to place their photo on a company server. It is probably a condition of employment.

Again, though, that would be a question best answered by your lawyers and/or management.
